OVERVIEW

Welcome to PEPA Lagos.

The terms “PEPA”, “PEPA Lagos”, “we”, “us” and “our” refer to PEPA Lagos. PEPA Lagos operates this website and online store, including all related information, content, features, tools, products and services provided to you (collectively, the “Services”).

Our store is powered by Shopify, which enables us to provide our Services and online shopping experience to you.

These Terms of Service, together with any policies referenced within them, describe the terms that apply when you access our website, browse our store, communicate with us or purchase products from PEPA.

Please read these Terms carefully before using our Services.

By visiting, interacting with or purchasing from PEPA, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms, you should not use our Services.

Nothing in these Terms is intended to limit any rights or remedies that cannot lawfully be excluded under applicable Nigerian law.

SECTION 1 – ACCESS AND ACCOUNT

By using our Services, you confirm that you are legally capable of entering into a binding agreement in your jurisdiction or that you are using the Services with the permission and supervision of a parent or legal guardian where required.

When placing an order, you may be required to provide information including your name, email address, telephone number, billing information, payment details and delivery address.

You represent and warrant that all information provided to PEPA is accurate, current and complete.

You are responsible for maintaining the confidentiality and security of any account credentials associated with our website and for activity carried out through your account.

You may not transfer, sell, assign or license your PEPA account to another person.

SECTION 2 – OUR PRODUCTS

We make every reasonable effort to display and describe PEPA products accurately.

However, colours, textures and the appearance of garments may vary slightly from how they appear on your screen due to differences in device displays, lighting, photography and screen settings.

As many of our pieces involve fabrics, trims, embellishments and production processes that may naturally vary, minor differences between individual garments may occur.

Please review all product descriptions, measurements and our size guide carefully before purchasing.

We reserve the right to:

  • Modify product descriptions where necessary;

  • Change or discontinue products without prior notice;

  • Limit the quantities available for purchase;

  • Restrict the sale of products to particular individuals, locations or jurisdictions where reasonably necessary; and

  • Correct genuine errors relating to product information, availability or pricing.

All products are subject to availability.

SECTION 3 – ORDERS

Placing an order with PEPA constitutes an offer to purchase the selected products.

Your order is not considered accepted until payment has been successfully received and your order has been confirmed.

PEPA reserves the right to decline or cancel an order where reasonably necessary, including where:

  • An item is unavailable;

  • There is an error in the price or product information;

  • Payment cannot be verified;

  • We reasonably suspect fraudulent or unauthorised activity; or

  • We are otherwise unable to fulfil the order.

Where PEPA cancels an order after payment has been received, the amount paid for the cancelled item or order will be returned to the customer as appropriate.

Please review your order carefully before completing your purchase.

Once an order has entered processing or production, we may be unable to accommodate changes to the order, including changes to the selected size, colour, style or delivery information.

Purchases are subject to our Returns, Exchanges & Store Credit Policy.

Unless otherwise agreed by PEPA, products purchased through our store are intended for personal use and not unauthorised commercial resale.

SECTION 4 – PRICES AND PAYMENT

All prices displayed on the PEPA website are shown in the currency stated on the website at the time of purchase.

Prices, promotions and discounts may change without prior notice.

The price payable for an item will be the price displayed when the order is completed, subject to the correction of genuine pricing errors.

Unless expressly stated otherwise, product prices do not include delivery charges.

Any applicable delivery fees will be displayed or communicated before your order is completed.

Where applicable, customers purchasing from outside Nigeria are responsible for any customs duties, import taxes or other charges imposed by the destination country.

You agree to provide accurate and complete billing and payment information.

By submitting payment details, you confirm that you are authorised to use the selected payment method.

PEPA reserves the right to cancel an order where payment cannot be verified or where fraudulent activity is reasonably suspected.

SECTION 5 – SHIPPING AND DELIVERY

All PEPA orders are processed and dispatched from Lagos, Nigeria.

Once payment has been successfully confirmed, please allow up to 5 business days for your order to be processed and dispatched.

Processing time is separate from delivery time.

Lagos Deliveries

Following dispatch, orders within Lagos typically arrive within approximately 1–2 business days, depending on the delivery location and courier availability.

Deliveries Outside Lagos

Orders being delivered outside Lagos but within Nigeria typically arrive within approximately 3–5 business days after dispatch.

Delivery estimates are provided as guidance and are not guaranteed.

PEPA will not be responsible for reasonable delays caused by circumstances outside our control, including courier disruptions, severe weather, traffic conditions, public holidays, logistics interruptions or other unforeseen circumstances.

Customers are responsible for providing a complete and accurate delivery address and telephone number.

Where a delivery cannot be completed due to incorrect information supplied by the customer, an unavailable recipient or another issue attributable to the customer, additional delivery charges may apply before the item can be resent.

If you are ordering an outfit for a specific event or date, we strongly recommend ordering well in advance.

SECTION 6 – RETURNS, EXCHANGES AND STORE CREDIT

PEPA does not ordinarily offer cash refunds for change of mind, incorrect sizing selections, style preferences or other standard returns.

Subject to our Returns Policy, eligible items may instead be returned for:

  • An exchange; or

  • PEPA store credit.

Customers wishing to request a standard return or exchange must contact PEPA within 5 days of receiving their order.

Items must meet the return requirements contained in our Returns, Exchanges & Store Credit Policy, including being unworn, unused, unwashed, unaltered and returned with original tags attached.

Items showing signs of wear, including makeup, perfume, deodorant, stains, odours, alterations or damage caused after delivery, may be refused.

Certain products may not qualify for standard returns for hygiene or product-specific reasons, including certain swimwear, bodysuits, intimate garments, bespoke or customised pieces and items designated as Final Sale.

These restrictions do not affect any rights or remedies that a customer may have under applicable Nigerian consumer protection law where goods are defective, unsafe, incorrect, misdescribed or otherwise fail to meet legally required standards.

Where PEPA is legally required to provide a particular remedy, the applicable law will take precedence over any conflicting provision of this policy.

SECTION 7 – INTELLECTUAL PROPERTY

The PEPA website and its contents, including but not limited to:

  • The PEPA name and branding;

  • Logos and brand marks;

  • Garment and graphic designs;

  • Original prints and patterns;

  • Photography;

  • Campaign imagery;

  • Videos;

  • Website graphics;

  • Written copy;

  • Product names;

  • Artwork;

  • Layouts; and

  • Other original creative materials

are owned by or licensed to PEPA and may be protected by applicable copyright, trademark and other intellectual property laws.

You may access our website for your personal and non-commercial use.

Unless expressly authorised by PEPA, you may not reproduce, copy, modify, republish, distribute, commercially exploit or create derivative works from PEPA's protected materials.

You may not use the PEPA name, logo, brand assets, designs, photography or other proprietary materials in connection with another business, product or commercial activity without our prior written permission.

All rights not expressly granted are reserved.

SECTION 8 – OPTIONAL AND THIRD-PARTY TOOLS

Our website may provide access to services, tools or functionality supplied by third parties.

PEPA may not control or monitor those third-party tools.

Your use of third-party services may also be subject to the terms and privacy policies of the relevant provider.

To the fullest extent permitted by applicable law, PEPA is not responsible for loss or damage arising solely from the independent acts or omissions of third-party service providers outside our reasonable control.

We may introduce new website features, tools and resources in the future. Such features will form part of the Services and will be subject to these Terms unless stated otherwise.

SECTION 9 – THIRD-PARTY LINKS

Our website may contain links to websites, platforms or services operated by third parties.

PEPA is not responsible for the content, accuracy, availability, privacy practices or services of third-party websites that we do not control.

If you choose to access a third-party website, you do so subject to that provider's own terms and policies.

Any complaint relating solely to a third-party product or service should be directed to the relevant third party.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

PEPA Lagos is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make through our store are made directly with PEPA Lagos.

By using the Services, you acknowledge and agree that Shopify is not the seller of PEPA products and is not responsible for fulfilment of your purchase.

Your contractual relationship in relation to PEPA products is with PEPA Lagos, subject to any obligations Shopify may independently owe to you under applicable law.

SECTION 11 – PRIVACY

Personal information collected through our Services is handled in accordance with our Privacy Policy and applicable data protection law.

As our store is hosted by Shopify, Shopify may process certain information relating to your access to and use of our store in order to provide its services.

Information may also be processed by payment providers, delivery companies and other service providers where reasonably necessary to fulfil your order and operate our business.

SECTION 12 – FEEDBACK, REVIEWS AND USER CONTENT

If you voluntarily send PEPA feedback, reviews, photographs, suggestions, comments or other content, you confirm that you have the necessary rights to provide that material.

Where you expressly provide or submit content for publication, reposting or promotional use, you grant PEPA a non-exclusive, worldwide, royalty-free licence to reproduce, publish, display and share that content in connection with the operation and promotion of PEPA.

You must not submit material that:

  • Infringes another person's intellectual property rights;

  • Violates another person's privacy;

  • Is knowingly false or misleading;

  • Is unlawful, defamatory or abusive; or

  • Contains malicious software or code.

You remain responsible for content you submit.

SECTION 13 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to matters including:

  • Product descriptions;

  • Prices;

  • Promotions;

  • Availability;

  • Delivery fees; or

  • Estimated delivery times.

We reserve the right to correct genuine errors or inaccuracies and to update information where necessary.

If an error materially affects an order you have already placed, we will take reasonable steps to notify you and, where appropriate, provide the remedies required by applicable law.

SECTION 14 – PROHIBITED USES

You may only use the PEPA website and Services for lawful purposes.

You must not use the Services to:

  • Infringe the intellectual property rights of PEPA or another party;

  • Submit false or misleading information;

  • Engage in fraud or attempted fraud;

  • Harass, threaten or abuse another person;

  • Transmit viruses, malicious code or harmful technologies;

  • Attempt to gain unauthorised access to our website or systems;

  • Interfere with website security or functionality;

  • Collect personal information about other users without lawful authority;

  • Spam, phish or engage in similar malicious activities;

  • Scrape, reproduce or commercially extract PEPA website content without permission; or

  • Use the Services in a way that materially interferes with another person's lawful use of the website.

We reserve the right to suspend or restrict access where we reasonably believe these Terms have been materially violated.

SECTION 15 – AUTOMATED AGENTS

Automated systems, software agents, bots or similar technologies must not access or interact with our Services in a manner that:

  • Misrepresents the automated system as a human user;

  • Circumvents security controls;

  • Bypasses restrictions placed on automated access;

  • Scrapes or commercially extracts PEPA content without permission; or

  • Interferes with the normal operation of our Services.

We may use reasonable technical measures to restrict or prevent unauthorised automated access.

SECTION 16 – TERMINATION

We reserve the right to suspend or terminate access to our Services where reasonably necessary, including in circumstances involving fraud, misuse, unlawful activity or a material breach of these Terms.

Termination will not affect rights or obligations that arose before termination.

Provisions that are intended by their nature to continue after termination, including provisions relating to intellectual property, liability, privacy and governing law, will continue to apply.

SECTION 17 – WARRANTIES

We aim to provide our Services accurately and reliably.

However, to the fullest extent permitted by applicable law, we do not guarantee that access to our website will always be uninterrupted, completely secure or error-free.

Nothing in these Terms excludes or limits warranties, guarantees, rights or remedies that cannot legally be excluded under applicable consumer protection law.

SECTION 18 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, PEPA will not be liable for indirect, incidental or consequential losses arising from use of our website where such losses were not reasonably foreseeable or were caused by matters outside our reasonable control.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms is intended to exclude or restrict any liability or consumer remedy that cannot lawfully be waived under applicable Nigerian law.

SECTION 19 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses or claims reasonably incurred by PEPA as a direct result of your unlawful use of the Services, infringement of third-party rights or material breach of these Terms.

Nothing in this section imposes liability on a customer beyond what is permitted by applicable law.

SECTION 20 – SEVERABILITY

If any provision of these Terms is determined by a court or competent authority to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

SECTION 21 – WAIVER AND ENTIRE AGREEMENT

If PEPA does not immediately exercise or enforce a right under these Terms, this does not mean that the right has been waived.

These Terms, together with our:

  • Privacy Policy;

  • Shipping & Delivery Policy;

  • Returns, Exchanges & Store Credit Policy; and

  • Any other policies displayed on our website

form the agreement governing your use of the PEPA Services.

Where a promotional offer is subject to additional specific terms, those additional terms will apply to that promotion.

SECTION 22 – ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

PEPA may transfer its rights or obligations in connection with a legitimate transfer, restructuring or sale of the business, subject to applicable law.

SECTION 23 – GOVERNING LAW

These Terms of Service and any separate agreements through which PEPA provides products or Services are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

Where a dispute arises, the parties should first attempt in good faith to resolve the matter directly.

Nothing in this section prevents a consumer from exercising any right to approach a competent regulator, tribunal or court available under applicable Nigerian law.

SECTION 24 – CHANGES TO THESE TERMS

You can review the most current version of these Terms of Service on this page at any time.

We reserve the right to update or amend these Terms by publishing the revised version on our website.

Where required by applicable law, we will provide appropriate notice of material changes.

The version of the Terms in force at the relevant time will apply to your use of the Services and purchases, subject to applicable law.
